Welcome to StoryMaker. These Terms of Service ("Terms") govern your use of the StoryMaker application and website at stories-now.app ("Service"), operated by StoryMaker ("we," "us," or "our"). By creating an account or using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. Accounts are intended for parents and guardians to create and manage stories for their families.

2. Account Registration & Family Accounts

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • As the account owner, you are responsible for all activity under your account, including activity by family members you add.
  • Child profiles are managed by the parent/guardian account owner. You are responsible for supervising children's use of the Service.
  • You may not create accounts for others without their consent.

3. User Content

"User Content" includes characters, themes, preferences, and any other input you provide to generate stories.

  • You retain ownership of the creative input you provide (character names, descriptions, story ideas).
  • You grant us a license to use your User Content solely for the purpose of providing and improving the Service (e.g., generating stories, maintaining story continuity).
  • You are responsible for ensuring your User Content does not violate any laws or third-party rights.

4. AI-Generated Content

StoryMaker uses artificial intelligence services to generate story text and illustrations. By using the Service, you acknowledge and agree:

  • AI limitations: AI-generated content may occasionally produce unexpected, inaccurate, or inappropriate results despite our best efforts to ensure age-appropriate output.
  • Parental review: Parents and guardians are responsible for reviewing AI-generated stories before sharing them with children.
  • Third-party processing: Story content is sent to third-party AI services (Anthropic and Google) for generation. These services process your input in accordance with their own privacy policies and terms.
  • No guarantees: We do not guarantee the accuracy, quality, or appropriateness of any AI-generated content.
  • Content ownership: AI-generated text and illustrations are provided for your personal, non-commercial use. You may print and share stories within your family.

5. Prohibited Uses

You agree not to use the Service to:

  • Generate content that is illegal, harmful, threatening, abusive, or hateful.
  • Create content depicting violence, abuse, or exploitation of children.
  • Attempt to bypass content safety filters or age-appropriate content controls.
  • Impersonate others or misrepresent your affiliation with any person or entity.
  • Interfere with or disrupt the Service or its infrastructure.
  • Use the Service for any commercial purpose without our prior written consent.
  • Scrape, mine, or automatically collect data from the Service.
  • Attempt to reverse-engineer or extract source code from the Service.

6. Subscription & Payments

StoryMaker offers free and premium subscription tiers. Details of each tier, including pricing and features, are displayed within the Service.

  • Free tier features may be limited (e.g., number of stories, characters, or image generations per month).
  • Premium subscriptions are billed on a recurring basis as specified at the time of purchase.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
  • We reserve the right to modify pricing with reasonable notice.

7. Service Availability

  • We strive to keep the Service available at all times but do not guarantee uninterrupted access.
  • The Service depends on third-party AI providers. If these services experience downtime, story generation may be temporarily unavailable.
  • We may modify, suspend, or discontinue any part of the Service with reasonable notice.

8. Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
  • Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
  • We are not responsible for the content, accuracy, or appropriateness of AI-generated stories or illustrations.

9. Intellectual Property

  • The StoryMaker name, logo, and all related branding are our intellectual property.
  • The Service's software, design, and underlying technology are protected by copyright and other intellectual property laws.
  • You may not copy, modify, or distribute any part of the Service without our written consent.

10. Termination

  • You may delete your account at any time by contacting us.
  • We may suspend or terminate your account if you violate these Terms or engage in prohibited uses.
  • Upon termination, your data will be handled in accordance with our Privacy Policy.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms shall be resolved in the courts of competent jurisdiction.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
